Terms & Conditions

These Terms of Service constitute a legally binding agreement (the "Agreement") between you and GariHub Limited, its subsidiaries, representatives, affiliates, officers and directors (collectively, "GariHub," "we," "us" or "our") governing your use of the GariHub application, website, and technology platform (collectively, the "GariHub Platform").

By entering into this Agreement, and/or by using or accessing the GariHub Platform you expressly acknowledge that you understand this Agreement. If you do not agree to be bound by the terms and conditions of this Agreement, you may not use or access the GariHub Platform or any of the services provided through the GariHub Platform.

GariHub Platform

The GariHub Platform provides a marketplace where Riders can be matched with transportation options provided by Drivers. As a User, you authorize GariHub to match you with a Driver or Rider based on factors such as your location, estimated time to pick up, your destination, user preferences, and platform efficiency. Each Ride Service constitutes a separate agreement between Driver and Rider.

Modification to the Agreement

GariHub reserves the right to modify these terms. Continued use of the GariHub Platform or Rideshare Services after any such changes constitutes your consent to the changes.

Eligibility

The GariHub Platform may only be used by individuals at least 18 years old who can satisfy these terms. Each person may only create one User account. You may not allow other persons to use your account.

Charges

Request or use of Ride Services may result in Charges including Fares, fees, tolls, surcharges, and applicable taxes. GariHub determines and may modify pricing.

  • Quoted Fares. A quote is subject to change until the ride request is confirmed. Changes to destination, multiple stops, or platform abuse may convert to a variable fare.
  • Variable Fares. Base charge plus incremental charges based on duration and distance, calculated using GPS data from the Driver's phone.
  • Prime Time. At times of high demand, Charges may increase substantially.
  • Cancellation Fee. Cancelling or failing to show up may incur a fee.
  • Damage Fee. If a Driver reports material damage, you agree to pay a Damage Fee toward repair or cleaning.
  • Miscellaneous Charges. Airport, state, local, or event fees and applicable taxes may apply.

No Refunds. All Charges are non-refundable.

Coupons. Coupons are only valid on the GariHub Platform, not transferable, and not redeemable for cash except as required by law.

Credit Card Authorization. GariHub may seek authorization of your selected payment method to verify it and protect against unauthorized behavior.

Communications

By using the GariHub Platform, you agree to receive communications from us via email, text, calls, and push notifications, including operational, promotional, and informational communications.

Your Information

You consent to us using your Information to create a User account and participate in Ride Services. You agree to provide accurate, current and complete information. You grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, transferable, sub-licensable license to use your Information for the purposes described in our Privacy Policy and this Agreement, while retaining ownership of your Information.

Restricted Activities

  • Impersonate any person or entity;
  • Stalk, threaten, or harass any person, or carry weapons;
  • Violate any law, statute, rule, permit, ordinance or regulation;
  • Interfere with or disrupt the GariHub Platform;
  • Post fraudulent, libelous, abusive, obscene, profane, harassing, or illegal content;
  • Infringe any third party's rights, including intellectual property;
  • Transmit malicious code or surreptitiously intercept data;
  • Forge headers or manipulate identifiers;
  • Reverse engineer, decompile, or disassemble any portion of the Platform;
  • Rent, lease, redistribute, or sublicense the Platform;
  • Use bots, spiders, scrapers, or data mine the Platform;
  • Transfer or sell your User account or another User's Information;
  • Discriminate against or harass anyone on the basis of race, origin, religion, gender, identity, disability, condition, marital status, age or sexual orientation.

Intellectual Property

All intellectual property rights in the GariHub Platform are owned by GariHub absolutely. GARIHUB and other GariHub logos are registered trademarks or trade dress in Kenya and other countries.

Disclaimers

GariHub does not provide transportation services and is not a transportation carrier. The Platform is provided "as is" without warranty of any kind. We do not guarantee accuracy, reliability, availability, security, or that the Platform is free of viruses. We cannot guarantee that each User is who they claim to be. GariHub is not responsible for the conduct of any User. You are responsible for the use of your account.

Indemnity

You will defend, indemnify, and hold GariHub harmless from any claims, actions, suits, losses, costs, liabilities and expenses (including reasonable attorneys' fees) relating to or arising out of your use of the Platform and participation in Ride Services.

Limitation of Liability

In no event will GariHub be liable to you for any incidental, special, exemplary, punitive, consequential, or indirect damages arising out of or in connection with the Platform, the Ride Services, or this Agreement, unless as a result of GariHub's negligence.

Term and Termination

This Agreement is effective upon creation of a User account and may be terminated by either party with notice or immediately for material breach. GariHub may deactivate accounts falling below rating thresholds or where action is necessary to protect community safety.

Dispute Resolution and Arbitration

You and GariHub agree to submit claims to binding individual arbitration (not class actions). Arbitration shall be administered under the Arbitration Act Kenya, 1995 by the Chartered Institute of Arbitrators Kenya. The location for Arbitration shall be Nairobi. Before initiating arbitration, the parties may attempt to negotiate informally for 30 days.

Confidentiality

You agree not to use technical, financial, strategic, proprietary or User information disclosed via the Platform for any purpose other than as contemplated herein, and not to disclose such information to third parties.

General

This Agreement shall be governed by the laws of the Republic of Kenya. If any provision is invalid, the remainder remains in force. This Agreement may be assigned by GariHub with notice. Notices to you may be given via the Platform, email or physical address provided during registration.

Our Service may contain links to third-party sites. We have no control over and assume no responsibility for their content, privacy policies, or practices.
